PENGATURAN PERSAINGAN USAHA INDUSTRI HIJAU PERUSAHAAN MANUFAKTUR : STUDI PERBANDINGAN INDONESIA DENGAN UNI EROPA

Penerapan industri hijau di Indonesia masih menghadapi berbagai hambatan, terutama dalam sektor manufaktur yang menjadi kontributor utama emisi gas rumah kaca. Ketatnya persaingan pasar membuat banyak pelaku usaha enggan mengadopsi praktik industri hijau karena tingginya biaya produksi dan risiko inflasi hijau. Selain itu, ketiadaan regulasi yang tegas menimbulkan ketidakpastian hukum. Sebagai perbandingan, Uni Eropa telah berhasil mengintegrasikan prinsip industri hijau ke dalam kebijakan persaingan usahanya, menjadikannya salah satu wilayah paling bersih di dunia. Penelitian ini membandingkan kerangka hukum Indonesia dan Uni Eropa terkait industri hijau dalam sektor manufaktur, dengan menggunakan pendekatan yuridis normatif berdasarkan peraturan perundang-undangan yang berlaku. Hasil kajian menunjukkan bahwa UU Persaingan Usaha Indonesia belum mengatur secara spesifik tentang industri hijau, sementara Uni Eropa memberikan ruang untuk kerja sama usaha yang mengutamakan manfaat lingkungan. Indonesia disarankan mengadopsi pendekatan serupa melalui harmonisasi UU Perindustrian dan penguatan undang undang energi baru terbarukan.
