Studi ini untuk mengetahui perlindungan hukum bagi pelaku usaha terhadap penyalahgunaan posisi dominan platform digital : marketplace melalui penetapan harga dan penguasaan pasar. Dalam konteks digital market yang terbentuk saat ini, pelaku usaha tidak lagi hanya berperan dalam proses jual beli tapi sampai pada upaya membangun reputasi yang baik hingga memiliki basis pembeli yang loyal dengan digital branding. Para pelaku usaha UMKM dapat memperoleh banyak keuntungan dengan platform digital. Persoalan muncul ketika terjadi persaingan usaha tidak sehat akibat penyalahgunaan posisi dominan platform digital oleh pelaku usaha atas pelaku usaha lainnya. Jenis penelitian ini adalah penelitian kualitatif, sebagai prosedur penelitian yang menghasilkan data deskriptif tentang permasalahan perlindungan hukum terhadap pelaku usaha ditinjau dari Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli Dan Persaingan Usaha Tidak Sehat yaitu kepastian hukum dalam perlindungan preventif dan represif. Pendekatan penelitian yang digunakan adalah pendekatan penelitian hukum normatif (legal research) untuk menemukan apakah ada hak pelaku usaha dalam platform digital di Indonesia telah diakomodir oleh Undang-Undang Persaingan Usaha. Perlindungan hukum bagi pelaku usaha terhadap penyalahgunaan posisi dominan platform digital : marketplace telah diakomodir oleh negara melalui Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli Dan Persaingan Usaha Tidak Sehat. Pasal 5 hingga Pasal 8 dan Pasal 19 huruf b telah secara tegas melarang hal tersebut sebagai langkah preventif dan mengatur sanksi secara administrasi dan pidana sebagai langkah represif. Artinya, secara perangkat hukum negara telah melindungi warga negaranya yang menjadi pelaku usaha. Hanya yang masih selalu terjadi adalah penegakkannya, baik pada proses persidangan maupun pelaksanaan sanksi oleh pelaku usaha yang dinyatakan bersalah berdasarkan Putusan KPPU.

5. Co-Authorship
If the article was jointly prepared by other authors, the signatory of this form warrants that he/she has been authorized by all co-authors to sign this agreement on their behalf, and agrees to inform his/her co-authors of the terms of this agreement.
6. Termination
This agreement can be terminated by the author or REUSAM upon two months notice where the other party has materially breached this agreement and failed to remedy such breach within a month of being given the terminating partys notice requesting such breach to be remedied. No breach or violation of this agreement will cause this agreement or any license granted in it to terminate automatically or affect the definition of REUSAM.
7. Royalties
This agreement entitles the author to no royalties or other fees. To such extent as legally permissible, the author waives his or her right to collect royalties relative to the article in respect of any use of the article by REUSAM or its sublicensee.
8. Miscellaneous
REUSAM will publish the article (or have it published) in the journal if the articles editorial process is successfully completed and REUSAM or its sublicensee has become obligated to have the article published. REUSAM may conform the article to a style of punctuation, spelling, capitalization, referencing and usage that it deems appropriate. The author acknowledges that the article may be published so that it will be publicly accessible and such access will be free of charge for the readers.
